Terms of Use and Services

Thank you for using TechBalance services (“Company”, “We” or “TechBalance”). The services are offered by TECHBALANCE SOLUÇÃO DIGITAL PARA REABILITAÇÃO LTDA, a legal entity governed by private law, regularly registered with the CNPJ/MF: 30.131.853/0001-23, headquartered at R. Augusta, 1168, 9th floor, São Paulo - SP, Brazil, CEP: 01304-001, owner and owner of software, website, applications, content and other assets related to TechBalance and the website www.techbalance.com.br (“Site”).

1. Object

TechBalance offers users (individually, "User") service of classes and online sessions of physical therapy, gymnastics and physical exercises, live or recorded, with the objective of developing strength, improving balance and mobility (such service, together with the Website and any other services that the Company offers to the User, “Services”).

2. Acceptance

This Term establishes obligations contracted of free and spontaneous will, for an indefinite period, between the Company and the User.

By using the Services, the User fully accepts these rules and undertakes to comply with them, at the risk of applying the applicable penalties.

The acceptance of this Term is essential for accessing and using the Services offered by the Company. If you do not agree with the provisions of this instrument, the User shall not use them.

The Services are suitable for persons over 18 years of age. By accepting this Term, the User confirms that he is 18 years old or older.

3. Registration

Access to the Services will require prior registration and, depending on the Services chosen, payment of a certain amount.

When registering, the User must provide complete, recent and valid data, and the User is solely responsible for keeping such data up to date, and the User undertakes to ensure the accuracy of the data provided.

Upon completion of registration, the User expressly declares and warrants to be fully capable, being able to freely exercise and enjoy the Services.

The User must provide a valid email address through which the Company will carry out all necessary communications.

It will not be allowed to assign, sell, rent or transfer, in any way, the User's account, which is personal and non-transferable.

It is the User's responsibility to ensure that their equipment and the speed and stability of their internet are compatible with the technical characteristics that enable the use and enjoyment of the Services.

The User may, at any time, request the cancellation of his registration with the Company. Your unsubscribe will be carried out as soon as possible, as long as no outstanding debts are identified.

The Company declares that it is in line with Law No. 13.709/18 (Personal Data Protection Law – LGPD) and that the data collected from the User will be used for the exclusive purposes of performing and improving the Services.

4. Services

The Services offered are described and presented with the highest degree of accuracy, containing information on their characteristics, qualities, quantities, composition, price, warranty, applicable terms, among other data, as well as the risks they may pose to the User's health .

When confirming the purchase of a certain Service, the User confirms that he is informed about its specifications and its destination.

5. Prices

The prices applied are those in effect on the date of order confirmation and are indicated in reais.

On the date of contracting the Services, the Company may request the User's financial information, such as CPF, billing address and card data. By entering such data, the User agrees that, according to the payment method chosen, the prices then in effect and informed at the time of contracting will be charged. Said financial data may be stored to facilitate access, recurring charges and future charges.

The contracting of the Services, when it occurs on a recurring basis, will be carried out automatically by the Company, regardless of communication to the User, upon periodic charging of the same form of payment indicated by the User when contracting the Services.

The Company reserves the right to unilaterally readjust, at any time, the values of the Services without prior consultation or consent of the User, being informed by the registered email, with a minimum period of 30 calendar days, the new values and the date of adjustment .

To contract Services with a free trial period, the User may be asked to fill in financial information prior to accessing the Services trial period. If the User wishes not to continue with the Services after the trial period, the User must cancel prior to the end of the trial period, pursuant to item 6 below.

6. Cancellation

The User may cancel the contracting of the Services in accordance with the terms defined at the time of contracting. Furthermore, the User may also cancel the services within 7 (seven) days after contracting, by contacting us by e-mail to suporte@techbalance.com.br or contato@techbalance.com.br , in accordance with the Defense Code of the Consumer (Law nº 8.078/90).

Services may be canceled by:

1. Part of the User: under these conditions, the Services will only terminate when the cycle in force at the time of cancellation is completed;

2. Violation of Terms of Service: The Services will terminate immediately.

7. Support

In case of doubts or problems regarding the use of the Services, the User may contact the support, through the email suporte@techbalance.com.br during business hours.

8. Responsibilities

It is the User's responsibility:

1. The correct use of the Services, valuing the good relationship, respect and cordiality with instructors, TechBalance employees, physiotherapists and other Users;

2. Compliance with and respect for the set of rules set forth in this Term of Service, in the respective Privacy Policy and in national legislation;

3. The protection of your account/profile access data (login and password).

It is the Company's responsibility:

1. Clearly indicate the characteristics of the Services;

2. Defects and technical problems in the provision of the Services, as long as they are caused;

3. The information disclosed by it, and comments and information disclosed by Users are the sole responsibility of the Users themselves.

The Company is not responsible for the content on external links contained in its system, platform or in the context of the Services, which may redirect the User to an environment outside its network.

9. Copyright

Website or application structure, brands, logos, trade names, layouts, graphics and interface designs, images, illustrations, photographs, presentations, videos, written and audio and sound content, computer programs, database, files. transmission and any other information and intellectual property rights of TECHBALANCE SOLUÇÃO DIGITAL PARA REABILITAÇÃO LTDA are duly reserved.

This Terms of Service does not assign or transfer any intellectual property rights to the User.

The use of the Services by the User is personal, individual and non-transferable, and any unauthorized use, whether commercial or non-commercial, is prohibited. Such uses will constitute infringement of intellectual property rights, punishable under applicable law.

10. Sanctions

Without prejudice to other applicable legal measures, the Company may, at any time, warn, suspend or cancel the User's account:

1. That violate any provision of this Term;

2. Who fails to comply with their User duties;

3. That exhibit any fraudulent, fraudulent or offending behavior to third parties in the context of the Services provided.

Under no circumstances shall the Company or its affiliates, employees, employees or partners be held liable by the User for any damages arising out of the use of the Services or interactions with the Company.

11. Termination

Failure to comply with the obligations set forth in this Terms of Service or the applicable legislation may, without prior notice, lead to immediate unilateral termination by the Company and the blocking of all Services provided to the User.

12. Changes

The items described in this instrument may be changed, unilaterally and at any time, by the Company, to adapt or modify the Services, as well as to meet new legal requirements. The changes will be published on the website www.techbalance.com.br and/or informed by the registered e-mail of the User.

The Services may, at any time and unilaterally, be changed in their characteristics, as well as restricted for use or access.

13. Privacy Policy

In addition to this instrument, the User must consent to the provisions contained in the respective Privacy Policy to be presented to all interested in the Services offered by the Company.

14. Of the Forum

For the settlement of disputes arising from this instrument, Brazilian Law will be fully applied.

Any disputes must be filed in the court in which the Company's headquarters are located.
